Legal Case: Against Borders for Children vs Secretary of State for Education

Liberty acted as lawyers for Against Borders for Children (ABC) in their challenge against the collection of nationality and country of birth data in the school census.

In 2016, the Department for Education started asking for children’s nationality and country of birth in the termly school census. It collected this data for approximately 8.67 million children aged 5 to 19 in schools. The data served no educational purpose, but was essentially creating lists of foreign children whose families could then be located and targeted for deportation.

The High Court dismissed the case, but ABC appealed. Before the case went for a hearing, the Government caved in and agreed to stop collecting nationality and country of birth data.
