Vehicle stops

Section 163 of the Road traffic Act 1988 allows police to stop any vehicle without justification or reason. This power will be bolstered with the new offence (not yet in force) under sections 43 and 44 of the Immigration Act 2016 of “driving when unlawfully in the UK”.

If you fail to stop this is an offence and you could be found guilty.

Unfortunately there is little you can do in these scenarios. It is important to bear in mind the police’s duty under the Equality Act 2010 and Children Act 2004.
